The Competition and Consumer Protection Commission says it will Investigate Airtel Networks Zambia Plc on allegations of a criminal act of diverting data to and from a phone number belonging to Lusaka Journalist Thomas Allan Zgambo.

This follows the lodging of a criminal complaint against Airtel Networks to the CCPC and Zambia Information and Communication Technology Authority (ZICTA). Mr. Zgambo lodged in an official complaint to ZICTA and CCPC in a letter dated September 11,2017.

In response to the letter, CCPC Executive Director Chilufya Sampa says the complaint will jointly be handled by CCPC and ZICTA. When contacted for a comment Mr. Zgambo confirmed the development. ” This matter is already in the High Court under Civil Jurisdiction but what I have taken to ZICTA and CCPC is a criminal complaint that should result into the prosecution of Airtel Directors.

I’m just waiting for one or two stakeholders to come on board but the overall intention is to private prosecute the company. This has nothing to do with the Civil matter that I have jointly pursued with Clayson Hamasaka. I emphasise this is a criminal complaint” he said.

Mr. Zgambo who volunteered to release the letter from CCPC said it is about time institutions respected the law of the Land.” I can not give you other documents because I have to protect the privacy of third parties but you can ask CCPC and ZICTA for the copies of the official complaint but what I can tell you is that under section 64 of the Electronic Communications and Transactions Act, it is an offense to intercept or attempt to intercept any communication” he said.
