A CYBER security specialist from ZICTA has told the Lusaka Magistrates’ Court that he cannot conclude that a Facebook account that he investigated on behalf of the police belonged to Asher Hakantu, a man accused of defaming PF deputy spokesperson Mumbi Phiri.
Hakantu is facing one count of libel but he denied the charge.In his examination-in-chief, Simatebe, 33, who is also a cyber inspector, testified before magistrate Nchimunya Simaubi that he was instructed by his superiors to investigate the connection of a mobile number and a Facebook account in the names of Asher Hakantu.
Simatebe told the court that he could not carry out a forensic analysis on any digital devices hence, he could not conclude that the mobile phone number was linked to the said Facebook account.
“In the absence of the devices or where digital forensic analysis was not carried out, I cannot draw a conclusion that the Facebook account is owned by the suspect,” he said.
And in cross-examination, Simatebe admitted that his testimony had nothing to do with what was contained on the indictment before court.
The allegation is that Hakantu between May 7 and 8, 2017, in Lusaka, with intent to defame Phiri, unlawfully published a defamatory matter on a WhatsApp group called “We need a better Zambia.”
The massage read, “Are you sure she didn’t sacrifice the innocent boy for her to come into the political limelight, who knew this finished scrap cargo before she lost her son in the Kawambwa school accident? Apusa maningi Mumbi Phiri.”
