“MWAMBA KAMBWILI DID NOT COMPLAIN TO POLICE ABOUT FORGERY OF HIS SIGNATURE BUT CHILUFYA TAYALI WHO LATER WITHDREW THE CASE FROM COURT,” WITNESS TELLS COURT.
The case in which the National Democratic Congress party (NDC) President Dr. Chishimba Kambwili has been dragged to court for allegedly forgery, altering of false documents and giving false information to a public officer came up this morning in the Lusaka magistrate court for continued trial.
On the stand for continued cross examination was the arresting officer in the matter Mr. Mumbula an Investigation Officer.
The defence lawyers Keith Mweemba, Gilbert Phiri and Christopher Mundia took turns in cross examining the witness who told the court that, he did not record any witness statement from Mwamba Kambwili and yet this is the person he claimed his signature was forged
The arresting officer further told the court that it is standard practice when investigating a forgery Case for investigators to collect signature samples or handwriting from a person being investigated. He added that in this case, he did not get any samples at the time he was investigating the accused during warn and caution.
The witness further told the court that the accused had nothing to do with the registarion of Mwamona Engineering and Technical Services.
During cross examination of the witness by Christopher Mundia defence Counsel the witness was shown some court papers which he was asked to read before the court, signed by a high Court Judge and a Mr. Chilufya Tayali.
The said documents he read indicated that Chilufya Tayali had withdrawn all statements issued to the accused in this matter and him being the only complainant of this matter.
Witness further told court that apart from Chilufya Tayali no one has ever complained to the police over forgery in this matter.
The state has since closed their case and Magistrate David Simusamba has given both the state and defense a week each in which to make submissions and has set 28th November 2019 as the date for ruling in this matter.
At court the NDC leader was accompanied by his aid-de-camp Christopher Kangwa, NDC Media Director Emmanuel Malite ,Lusaka Provincial Youth Chairman Nachama Shimulinda and Dr.Kambwili’s Private Secretary Fabian Mutale who joined later.
Upon arrival at court, Lusaka District Secretary Kwangu Mukupa lead NDC officials in welcoming the NDC leader.
The officials included Kanyama constituency, Chawama constituency and Lusaka Central constituency.
