The Livingstone magistrates court has acquitted a 22 year old woman who was accused of having stolen K4,800 from her client.
This is in a case of Sharon Mubita of Vanessa Lodge in Kazungula district was charged with theft.
It was alleged that on September 7 this year, at Zambezi Guest house in Kazungula district, around 03:00hrs, Sharon stole K4,800 from Golden Makayi Nyambe, 22, of Mambova area.
The court heard that a night before the incident, Mr Makayi had picked another Woman whom he had sex with.
Mr makayi decided to go back drinking after the first sexual encounter and later at the bar picked up Sharon and went with her to the lodge.
The court heard that Sharon charged Mr makayi K100 for the service and that Mr Makayi overslept thereafter and was only woken up around 05:00 hours to have a morning glory round the following day by Sharon.
Mr Makayi searched Sharon in an effort to find the money on her body.
The matter was reported to the police and Sharon was further searched but nothing was found on her.
In passing a judgement, chief resident magistrate Willie Sinyangwe said the prosecution had failed to prove the case beyond reasonable doubt.
He said, Mr makayi did not explain if he had shown Sharon the money. Magistrate Sinyangwe said there was a discrepancy on the time the money was stolen from Mr makayi. He said Sharon was being acquitted due to inconsistencies in the evidence.
